Waiver & Release of Liability

Welcome to My Fitness Space, operated by Saniour Ltd.

This Waiver applies to all users of My Fitness Space. Before booking a session, purchasing a membership, or using our facilities, you will be required to review and accept this Waiver as part of the booking or purchase process. We encourage all users to read it carefully.

1. Health Declaration

I confirm that:

• I am physically capable of participating in exercise and using the facilities and equipment at My Fitness Space.
• I am responsible for consulting a qualified medical professional before participating if I have any medical condition, injury, illness or concern that may affect my ability to exercise safely.
• I will not use the facilities while under the influence of alcohol, illegal drugs or any substance that may impair my judgement or physical ability.
• I will immediately stop exercising if I experience pain, dizziness, discomfort or any unusual symptoms.

2. Assumption of Risk

I understand that participating in physical exercise, strength training, cardiovascular training and the use of fitness equipment involves inherent risks, including but not limited to:

• Slips, trips and falls.
• Muscle strains and sprains.
• Joint injuries.
• Equipment malfunction or misuse.
• Serious injury.
• Permanent disability.
• Death.

I voluntarily accept and assume all risks associated with my participation and use of the facilities.

3. Personal Responsibility

I understand that My Fitness Space operates as a self-service facility and that training sessions may take place without supervision.

I accept full responsibility for exercising safely and within my own abilities at all times.

I agree to:

• Exercise within my own abilities.
• Use equipment only for its intended purpose.
• Inspect equipment before use and report any damaged or unsafe equipment immediately.
• Follow all posted safety notices and instructions.
• Respect the facility and other users.

4. Release of Liability

To the fullest extent permitted by applicable law, I release and discharge Saniour Ltd, trading as My Fitness Space, together with its directors, officers, employees, hotel personnel, contractors and approved Coaching Partners, from any liability for injury, illness, death, loss or damage arising directly or indirectly from my use of the facilities, except where such liability results from negligence, wilful misconduct or any liability that cannot legally be excluded.

5. Emergency Medical Assistance

If My Fitness Space reasonably believes that I require emergency medical assistance, I authorise staff or hotel personnel to contact emergency services on my behalf.

I understand that any medical treatment received and any associated costs remain my sole responsibility.

6. Governing Law

This Waiver shall be governed by and interpreted in accordance with the laws of the Republic of Cyprus.

Any dispute arising from this Waiver shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.

7. Booking & Cancellation Acknowledgement

For Single Session bookings:

• Bookings may be cancelled up to 30 minutes before the scheduled session.
• Eligible cancellations are entitled to a refund to the original payment method. Refunds are processed through the booking platform and typically appear within 5–7 business days, depending on the customer’s payment provider.
• Bookings cancelled less than 30 minutes before the scheduled session, or failure to attend, may result in the loss of the session without refund.

8. Acceptance

By accepting this Waiver during the booking, purchase or membership process, I confirm that:

• I have carefully read and understood this Waiver.
• I understand the risks associated with participating in physical exercise and using the facilities.
• I voluntarily accept those risks.
• I understand that this Waiver is legally binding to the fullest extent permitted by applicable law.
• I confirm that I am accepting this Waiver voluntarily and without coercion.
